The answer to this question is important because it might prove that the other party might not be held liable for the injury. This is because there is no duty to be careful toward the person who was injured.

Does comparative negligence apply to the accident? Of course, it’s possible that the person who got injured also had a part to play in the accident, however small it might be. The rules of comparative negligence indicate that a person who is more responsible for the accident will pay for the bigger part of the damages.

Was the negligent party working for a company when the accident happened? Some accidents happen because somebody was careless on the job. If this is the case, then the employer of the negligent party may also be held liable for the accident.

Was the accident caused by a poorly built, or a poorly maintained part of a building or establishment? Chances are, the owner of the property would also be considered negligent because he/she did not do his/her part in keeping the property safe.

Was the accident caused by a defective product? If so, then the manufacturer or seller may be considered liable even if the injured party did not know exactly how or where the negligence happened.

Through friends and acquaintances – One of the best ways to get a good lawyer is through the referrals of your family, friends, and acquaintances. When you come across somebody who is referred by somebody whom you trust, put the name in your list of possible candidates but do not decide on it right away.     This depends on the rules of civil procedure for your state. If you live in the same county as the court they likely have personal jurisdiction. The fact that you know somehow that ther is a law suit pending against you will likely make the failure of proper service irrelevant. If you show up to argue improper service the court will likely say, "Well you know about the law suit enough to show up her today." Service is all about notice and is really seperate from personal jurisdiction.

    There are several different way to perfect service, if they don't do it right this time, you can bet they will in the future. General rule, if you know about the suit you should show up.

    A personal statement is your opportunity to impress the scholarship sponsor with your commitment to education. Scholarship-granting organizations realize that there are a lot of students who could use money for school, but they can only help a very select few, and they hope to choose wisely, so that they can assist a few students who are really going to benefit from the assistance. That's where a personal statement comes in.

    Tell the committee about your hopes and dreams – what would you like to do with your education? Obviously, if you're planning on preparing for a career in a "helping" profession, then you're going to appeal to an organization that is committed to helping people like you.

    If you want to be a doctor, or a nurse, or a teacher, or a social worker – these are the kinds of things that would most impress a scholarship organization. Use the statement to explain what you want to do, and why. The more "thought out" your explanation, the stronger your essay will be. "I have always enjoyed learning about other people and cultures" is a pretty generic statement that won't really impress, but something like "Because I have struggled my whole life with ____ and worked so hard to overcome it, I truly believe that my example can serve as encouragement to the clients I would be working with at my law practice." (or whatever).

    If there is something in your high school record that you might wish was a little more solid – like some bad grades that you got in math, for example – use part of the statement to explain what went wrong, what lessons you learned, and how you intend to overcome those weaknesses. That's useful advice for dealing with college applications, too – the committee WILL notice the weakness, and if you can explain it in your own words, and make it into a positive that you've learned from, that's better than leaving them wondering what went wrong.
