California Third Party Work Injury Lawyer: A Case Study – Workplace Explosion
It is important that seriously injured workers and their families understand how California work injury law operates. In order to illustrate California worker injury law the following is a workplace case study for a fire and explosion work place accident in California. The discussion includes a California workers compensation analysis and a California third party work injury liability analysis.
A Case Study – Explosion and Fire – - Death and Serious Burn Injuries
Loony Demolition, Inc. installs, removes and junks gasoline pumps and underground tanks. A Loony Demolition, Inc. worker was using a portable power saw to cut a storage tank that had been used for underground storage at a gas station. The company failed to adequately purge the tank and test for vapors before beginning to cut and an explosion ensued, killing the employee and seriously injuring three others.
The three injured workers in the explosion worked for a different company, Joe’s Paving. They all suffered full thickness burns and had to be resuscitated at the local Burn Unit. On a daily basis they endured a horribly painful burn treatment called debridement. Debridement is the process of surgically removing dead tissue around a burn. Living Hell is a much more telling and accurate description. They were discharged from the hospital with amputation, scarring, disfigurement and indescribable pain. All three workers were unable to return back to work due to their injuries.
Investigation:
An investigation into the Loony Demolition, Inc. incident revealed:
1. Failed to test the atmosphere in tank prior to work or cutting.2. Failed to establish guidelines for gas-freeing.3. Failed follow the recommended procedures set forth in American Petroleum Institute (API) Bulletin 1604, “Recommended Practice for Abandonment or Removal of Used Underground Service Station Tanks”.4. Failed to train employees to recognize and then avoid unsafe conditions while working with tanks which have previously contained flammable liquids. This is in violation of 29 CFR 1926.21(b)(2) and the California equivalent.
Workers Compensation Analysis:
The Loony Demolition, Inc. employee whom died had a wife and two children. Under the California workers compensation system they were entitled to receive Death Benefits. The family received less than $290,000, an extremely unjust and unfair amount in the face of the devastation of losing a husband and father.
The Joe’s Paving employees were also entitled to benefits under the California workers compensation system. However, California Workers’ Compensation benefits are low and they are in a continual battle with the workers compensation carrier over appropriate medical treatment. After almost two years of enduring the unfair California workers’ compensation system these workers and their families were barely making ends meet.
Third Party Work Injury Analysis:
The family of the Loony Demolition, Inc. employee whom died has no third party defendant to sue. The family is only entitled to California workers compensation death benefits.
The employees of Joe’s Paving have a strong liability case against Loony Demolition, Inc. Loony Demolition, Inc. was clearly responsible for the explosion and fire. In this case, Loony Demolition, Inc. is termed a “third-party.” The three injured workers from Joe’s Paving bring a third party work injury lawsuit against Loony Demolition, Inc.
The workplace explosion was caused by the failure of the third party, Loony Demolition, Inc., to test the tank prior to cutting, this breached established guidelines for gas-freeing. Including, API procedures, OSHA requirements and longstanding custom and practice in the industry. These horribly injured employees recover many millions of dollars for their injuries.
However, money is not the true issue. The money can never replace what these catastrophically injured workers have lost. No matter what the sum. The pain and despair are unbearable.

I imagine a large enough powder magnesium bomb under the right implications would create an explosion with such an immense heat that the liquids would vaporize; realistically though, in my line of work (Submarines), our biggest concern is a steam rupture. Several hundred pounds of steam blowing out in a forced direction will certainly vaporize any soft tissue; if the explosion is violent enough, then the shock may shatter the bones into fragments small enough to vaporize as well. The only other way to get a reaction like that, maybe would be an extremely concentrated electric shock- but that kind of power would probably only be produced in VERY few places around the world.

Downsizing means layoffs, and if done in global scale -> High unemployment rates -> Unemployed people gets less income to spend, so they start reducing spendings on normal goods (eg. luxury steaks) and switch to inferior goods (eg. fast food) -> companies producing normal goods start to lose profits, thus cuts spending on advertising and human resource -> another downsizing, therefore more layoffs, and the cycle continues -> as companies and consumers begun to cut spending on global scale, banks begin to fail due to lack of borrowers (remember, bank earns money by lending and lose money from paying interest on your deposits) -> Because banks are failing, people start to panic and try to hold money as much as possible -> this creates less and less circulation on money, therefore the entire economy starts to fail.
This cycle is called multiplier effect. If any of these steps can be reversed, the problem can be quickly resolved because effects are multiplying through each process.
Government usually interfere during one of these steps to prevent such disastrous event, such as cutting interest rate, giving stimulus package, cutting taxes, and bailing out failing companies. (sounds familiar?) The Great Depression happened when the government acted too slow.

Specific risks for the preterm neonate
Preterm infants usually show physical signs of prematurity in reverse proportion to the gestational age. As a result they are at risk for numerous medical problems affecting different organ systems.
* Neurological problems include apnea of prematurity, hypoxic-ischemic encephalopathy (HIE), retinopathy of prematurity (ROP), developmental disability, cerebral palsy and intraventricular hemorrhage, the latter affecting 25 percent of babies born preterm, usually before 32 weeks of pregnancy.[8] Mild brain bleeds usually leave no or few lasting complications, but severe bleeds often result in brain damage or even death.[8]
* Cardiovascular complications may arise from the failure of the ductus arteriosus to close after birth: patent ductus arteriosus (PDA).
* Respiratory problems are common, specifically the respiratory distress syndrome (RDS or IRDS) (previously called hyaline membrane disease). Another problem can be chronic lung disease (previously called bronchopulmonary dysplasia or BPD).
* Gastrointestinal and metabolic issues can arise from hypoglycemia, feeding difficulties, rickets of prematurity, hypocalcemia, inguinal hernia, and necrotizing enterocolitis (NEC).
* Hematologic complications include anemia of prematurity, thrombocytopenia, and hyperbilirubinemia (jaundice) that can lead to kernicterus.
* Infectious include sepsis, pneumonia, and urinary tract infection [2]
Epidemiology
In Europe and many developed countries the preterm birth rate is generally 5–9%, and in the USA it has even risen to 12–13% in the last decades.[1] Three obstetric events precede preterm birth: spontaneous preterm births are the 40–45% preterm births that follow preterm labor and the 25–30% preterm births after premature rupture of membranes. The remainder (30–35%) are preterm births that are induced for obstetrical reasons; obstetricians may have to deliver the baby preterm because of a deteriorating intrauterine environment (i.e. infection, intrauterine growth retardation) or significant endangerment of the maternal health (i.e. preeclampsia, cancer). By gestational age, 5% of preterm births occur at less than 28 weeks (extreme prematurity), 15% at 28–31 weeks (severe prematurity), 20% at 32–33 weeks (moderate prematurity), and 60–70% at 34–36 weeks (near term).[1]
As weight is easier to determine than gestational age, the World Health Organization tracks rates of low birth weight (< 2,500 grams), which occurred in 16.5 percent of births in less developed regions in 2000.[77] It is estimated that one-third of these low birth weight deliveries are due to preterm delivery. Weight generally correlates to gestational age, however, infants may be underweight for other reasons than a preterm delivery. Neonates of low birth weight (LBW) have a birth weight of less than 2500 g (5 lb 8 oz) and are mostly but not exclusively preterm babies as they also include small for gestational age (SGA) babies. Weight-based classification further recognizes Very Low Birth Weight (VLBW) which is less than 1500 g, and Extremely Low Birth Weight (ELBW) which is less than 1000 g.[78] Almost all neonates in these latter two groups are born preterm.
Preterm birth is a significant cost factor in healthcare, not even considering the expenses of long-term care for individuals with disabilities due to preterm birth. A 2003 study in the US determined neonatal costs to be $224,400 for a newborn at 500–700 g versus $1,000 at over 3,000 g. The costs increase exponentially with decreasing gestational age and weight.[79]
Notable births -
James Elgin Gill (born on 20 May 1987 in Ottawa, Canada) was the earliest premature baby in the world. He was 128 days premature (21 weeks and 5 days gestation) and weighed 1 pound 6 ounces (624 g). He survived and is quite healthy.[80][81]
Amillia Taylor is also often cited as the most-premature baby.[82] She was born on 24 October 2006 in Miami, Florida, at 21 weeks and 6 days gestation.[83] This report has created some confusion as her gestation was measured from the date of conception (through in-vitro fertilization) rather than the date of her mother's last menstrual period making her appear 2 weeks younger than if gestation was calculated by the more common method.[74] At birth, she was 9 inches (22.86 cm) long and weighed 10 ounces (283 grams).[82] She suffered digestive and respiratory problems, together with a brain hemorrhage. She was discharged from the Baptist Children's Hospital on 20 February 2007.[82]
